1. Acceptance of Terms
By accessing and using this website ("Site"), operated by Memphis Cash Connect, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Site.
2. Service Description
Memphis Cash Connect is NOT a lender. We are not a direct lender. We are a matching service that connects borrowers with third-party lenders. We do not make lending decisions, fund loans, or determine rates and terms. We provide a free service to connect consumers with lenders who may offer short-term loans. We do not make credit decisions, set loan terms, or charge fees to consumers.
3. Not a Lender
We are not a direct lender. We are a matching service that connects borrowers with third-party lenders. We do not make lending decisions, fund loans, or determine rates and terms. The actual lender is responsible for all aspects of the loan, including the application process, approval, funding, and collections. Loan terms, including APR, fees, and repayment terms, are set solely by the lender.
4. No Guarantee of Approval
Submitting a loan request through our Site does not guarantee that you will be matched with a lender or approved for a loan. Approval is at the sole discretion of the lender and depends on the information you provide and the lender's underwriting criteria.
5. Credit Checks and Reporting
Lenders in our network may perform credit checks or verify your information through alternative databases (like Clarity or DataX). Submitting a form does not guarantee loan approval. By submitting your information, you authorize lenders to verify your information and perform credit checks as permitted by law.
6. APR Disclosure
APR varies by lender and state. Traditional Tennessee payday loans may carry APRs up to 460%, while Flex loans may carry effective APRs up to 279%. Your lender will provide full disclosures.
7. Financial Responsibility
Short-term loans should be used for short-term financial needs only, not as a long-term financial solution. Borrowers with credit difficulties should seek credit counseling. You are responsible for carefully reviewing the loan agreement provided by the lender before accepting any loan offer.
8. State Regulations
Loan availability, terms, and regulations vary by state. Not all lenders operate in all states. Tennessee residents are subject to state regulations governing deferred presentment services and flex loans. The maximum payday loan amount is $500. Rollovers are strictly prohibited. Flex loans are capped at a $4,000 outstanding balance.
9. Limitation of Liability
Memphis Cash Connect shall not be liable for any damages arising from the use of this Site or any loan obtained through a lender connected via our service. All information is provided "as is" without warranty.
